These General Terms and Conditions of Use and Contract (hereinafter, “the General Terms and Conditions”) govern, together with the Privacy Policy and the Cookies Policy, access to and use of the website accessible via the domain name www.garciacarrion.es and its subdomains, as well as the purchase of products and/or services through it. Merely accessing the Website confers the status of Website User upon the person doing so and implies acceptance of all the terms set out in these General Terms and Conditions. If the User does not agree with these General Terms and Conditions, they must immediately leave the Website without using it.

In compliance with Spanish Law 34/2002 on Information Society Services and Electronic Commerce, we hereby inform you that this website is owned by J García Carrión, S.A. Access to our website by the USER is free of charge and is subject to the USER having first read and fully, expressly and unreservedly accepted these GENERAL TERMS AND CONDITIONS OF USE in force at the time of access; we ask that you read them carefully. By using our website, its content or services, the USER expressly accepts and agrees to be bound by these general terms and conditions of use. If the user does not agree to these terms and conditions of use, they must refrain from using this website and carrying out any transactions via it.
1.2.-These General Terms and Conditions of Use of the Website, together with the general terms and conditions governing the provision of services, and/or any specific terms and conditions that may be established, are intended to regulate both the provision of information and the commercial relationships arising between García Carrión and the Users of the Website.
By browsing the Portal and/or using the services included therein (Registration, Newsletter or Shop), you become a User. Both browsing and the use of any of the Portal’s services imply acceptance as a User, without reservations of any kind, to each and every one of these General Terms and Conditions of Use, to the General Terms and Conditions of Contract which, where applicable, govern the provision of the services offered on the Portal, and, where applicable, to any Specific Terms and Conditions that may exist in relation to the provision of the services.
1.3.-García Carrión may, at any time and without prior notice, amend these General Terms and Conditions, as well as the General Terms and Conditions of Contract set out in the following section (number 2), and/or any specific terms and conditions that may be included, by publishing such amendments on the Portal so that Users may be made aware of them, always prior to visiting the Portal or purchasing any goods offered on the Portal.
2. General Terms and Conditions of the https://garciacarrion.com/ online shop
2.1. General Terms and Conditions.
2.1.1.-These General Terms and Conditions, together with any specific terms and conditions that may be established, shall expressly govern the relationships arising between García Carrión and the “Users” who use the Shop, as well as with third parties who purchase the products offered through it.
2.1.2.-These General Terms and Conditions have been drawn up in accordance with the provisions of the following legislation:
Law 7/1998 on General Terms and Conditions of Contract,
Law 7/1996 on the Regulation of Retail Trade,
Royal Decree-Law 14/1999 regulating Electronic Signatures,
Royal Legislative Decree 1/2007 of 16 November, approving the consolidated text of the General Law for the Protection of Consumers and Users and other supplementary laws.
Organic Law 3/2018 of 5 December on the Protection of Personal Data and the Guarantee of Digital Rights.
2.2. Products on offer. Purchasing system.
2.2.1. The products on offer in the Shop, together with their specifications and prices, will be displayed on screen.
The delivery charges for the products to the User’s address will also be displayed on screen; these will vary depending on the destination (within or outside Spain) and the number of boxes dispatched. Delivery charges will be invoiced per full box, in multiples of six bottles per box for 0.75 cl bottles, with these charges rounded up to the nearest multiple of six (6) bottles when the number of bottles requested by the User is not a multiple of six (6).
Products will be available for sale whilst stocks last. The prices shown on screen are in euros and include VAT and any other applicable taxes; they are the current prices.
Special offers will be clearly indicated on screen. García Carrión reserves the right to decide, at any time, which products are stocked and offered to Users via the Shop. Accordingly, García Carrión may at any time add new products to those included in the Shop, on the understanding that, unless otherwise specified, such new products shall be governed by the provisions of the General Terms and Conditions in force at that time.
Furthermore, García Carrión reserves the right to withdraw access, at any time and without prior notice, to any of the products offered in the Shop.
2.2.2.-To purchase the products offered in the Shop, García Carrión will ask Users to register. To do so, such Users, who must be aged eighteen (18) or over, must follow the on-screen instructions, which will require them to carry out the following steps:
Completing in full the electronic form displayed on the Portal at any given time, following the instructions provided therein.
Clicking the “Accept” button.
Receiving the “Username” and “Password” in the User’s email account.
The Username and Password are personal and non-transferable. García Carrión may, with adequate prior notice, make changes to the username and/or password, in which case the modified credentials will cease to be valid.
2.2.3. -Once the User has registered, and in order to proceed with the purchase of Products, they must add the desired product to the Shopping Basket, following the on-screen instructions, completing the order form provided for this purpose and submitting it to García Carrión, which implies that they have read and accepted all these General Terms and Conditions, as well as any applicable Specific Terms and Conditions.
The purchase shall be deemed to have taken place at the registered office of García Carrión, situated at Carretera de Murcia s/n, 30520 Jumilla (Murcia).
2.2.4. -Once the purchase has been made and as soon as possible, and in any event within thirty (30) days of the purchase being completed, García Carrión’s Customer Services Department will send the relevant invoice to the purchasing User who has requested it, either to the address indicated on the form or by email to the email address the User provided during registration. The order confirmation sent by García Carrión shall not be valid as an invoice, but only as proof of purchase.
2.3.-Method of payment, delivery and cancellation of orders.
2.3.1. Payment for the goods purchased and the associated delivery charges may be made by credit card, bank transfer, PayPal or Bizum.
To make a payment by credit card, the User must follow the on-screen instructions, providing the following information:
Card number.
Expiry date.
Card CVV2 or CVC2 code
As an electronic payment system, García Carrión is registered with the Santander Elavon e-commerce payment gateway. All data provided for this purpose is encrypted using the SSL (Secure Sockets Layer) protocol to ensure maximum security.
García Carrión reserves the right to request that any User of the Shop who has made a purchase provide proof of payment and/or identify themselves by submitting, via electronic means (fax, email or similar), a document identifying them as the purchaser and which may include the delivery address (National Identity Card, passport, resident’s card, certificate of residence, etc.).
2.3.2.-García Carrión undertakes to deliver the goods purchased by the User to the buyer’s address specified for this purpose on the order form (products will not be delivered to PO boxes or post office collection points), as soon as possible and, in any event, always within two (2) working days to the mainland or four (4) working days (Monday to Friday) from the date the order is placed (excluding public holidays and weekends). The delivery costs for the items purchased shall be borne by the Buyer.
2.3.3.-The User-Purchaser shall have a period of fourteen (14) working days, in accordance with the official calendar of their place of residence, to cancel the sale without incurring any penalty or cost, except for the costs associated with the delivery and return of the goods.
The fourteen-day period set out in the previous paragraph shall be calculated from the date on which the buyer receives the goods purchased. However, if the buyer became aware of the right of withdrawal after the date of receipt of the goods purchased, the fourteen-day period shall begin on the date on which they became aware of their right to return the goods purchased, at their own expense. In any event, it shall be deemed that the buyer has been aware of the right of withdrawal from the moment they enter the Shop, which requires them to read and accept these General Terms and Conditions of Contract, and in any case from the moment they place the order.
Once the buyer has exercised their right of withdrawal and the goods have been verified as being in perfect and unaltered condition upon arrival at García Carrión’s warehouse, the company will refund the amounts received by credit note, without any deductions, except for delivery and collection costs, immediately and in any event within a period not exceeding thirty days.
However, the above does not apply to the right of withdrawal in cases where, due to the nature of the services provided, it is impossible to exercise this right, without prejudice to any claim for damages suffered, or where the goods returned to the warehouse or their packaging are incomplete and/or not in perfect condition.
3. Information on the Right of Withdrawal
You have the right to withdraw from this contract within 14 calendar days without giving any reason.
The withdrawal period will expire 14 calendar days from the day on which you, or a third party designated by you (other than the carrier), took physical possession of the goods (or, failing that, the last of those goods).
To exercise your right of withdrawal, you must notify us of your decision to withdraw from the contract by means of an unequivocal statement (for example, a letter sent by post, fax or email) stating your name, your full address and, if available, your telephone number, fax number and email address to atcliente@jgc.es.
